Who Should Attend

Do you work in an IP or patent department, or as a patent attorney or lawyer in private practice, and want to draft stronger patent applications for GreenTech inventions while deepening your understanding of the enforcement and strategic use of European GreenTech patents? Then this course is for you.

Objective of the Event

GreenTech inventions are developed in rapidly evolving technological fields. Their environmental contribution may be central to the invention, but it does not, by itself, establish patentability. Patent practitioners must translate a technical and sometimes highly complex sustainability concept into claims that are clear, defensible and commercially relevant.

This course provides a practical framework for addressing these issues throughout the patent lifecycle, before focusing on the drafting, prosecution, enforcement and strategic use of European GreenTech patents.

Participants will consider how to formulate robust claims, develop meaningful intermediate fallback positions and anticipate infringement scenarios from the outset.

The workshop transfers these principles into practice. Working in two teams of no more than six participants each, participants will address GreenTech patent infringement and freedom-to-operate scenarios.

By attending the course, participants will be able to:

  • assess how the green character of an invention should be presented in the patent application and distinguish technically meaningful features from merely promotional adjectives;
  • draft and refine GreenTech claims using appropriate claim language and claim categories;
  • develop claims with likely infringement scenarios in mind and formulate effective intermediate fallback positions;
  • evaluate filing strategies for GreenTech inventions in light of commercial markets, enforcement options and freedom-to-operate considerations;
  • apply claim-drafting and freedom-to-operate principles to practical GreenTech infringement scenarios.
