G 1/24: Impact on Art 123(2) EPC

Although Question 1 of the referral leading to G 1/24 has been limited to Art 52-57 EPC, the outcome of G 1/24 can have a direct influence on how Art 123(2) EPC is dealt with in the future.

The question is whether the concept of 'directly and unambiguously derivable' which applies, inter alia, for novelty and added subjectmatter, will be pursued. Some boards had previously considered that Art 69(1) EPC and Art 1 of the Protocol on interpretation should be applied when dealing with Art 123(2) EPC.

This makes this seminar on Art 123(2) even more important.
